
General Terms & Conditions
Applicable to all bookings.
1. Introduction
These Terms and Conditions govern the use of services offered by Divers Tribe World Co. (hereinafter referred to as "Divers Tribe", "we", "our"), acting as an intermediary between clients and the final service providers (such as dive centers, accommodations, transportation, tour operators, etc.).
By booking any of our programs, trips, or services, the client (hereinafter referred to as "the client", "you") expressly accepts the terms outlined herein, which form an integral part of the agreement between both parties.
Divers Tribe is not the direct provider of travel or diving services unless explicitly stated. Our role is to organize, coordinate, and facilitate diving and travel experiences, carefully selecting our collaborators and providers based on quality and safety criteria.

2. Services Offered
Divers Tribe organizes diving experiences, training programs, cultural activities, and other complementary services related to adventure tourism and the underwater world.
The specific details of each experience or package (including itinerary, inclusions, exclusions, prices, and particular conditions) are communicated through the respective technical sheets, publications, and informational materials.

3. Intermediary Role
Divers Tribe acts exclusively as an intermediary between the client and the final providers of the contracted services. In this regard:

We do not assume direct responsibility for the execution of services provided by third parties.

We do not guarantee the punctuality or quality of such services beyond the due diligence applied in selecting our collaborators.

Any claims related to the execution of a service must be addressed directly to the corresponding provider, without prejudice to the support we may offer.
This limitation of liability does not affect the consumer's inalienable rights under applicable legislation.

4. Client Requirements
By booking, the client declares that:

They are in physical and psychological condition suitable for participating in the activities.

They hold a valid and current diving certification when the activity requires it.

They have been informed about the inherent risks of diving and/or adventure tourism and voluntarily accept them.

They complete and sign the required waiver forms, medical declarations, and any other necessary documentation before the start of activities.

They possess the necessary passport, visas, vaccinations, or any other travel requirements for the chosen destination.
5. Reservations and Payments

A reservation is only considered confirmed after the indicated deposit has been paid and these terms have been expressly accepted.

The remaining amount must be paid within the communicated deadlines.

Failure to pay on time entitles Divers Tribe to cancel the reservation without a refund of the deposit.

All prices are expressed in the specified currency and are per person unless otherwise stated. Rates may be subject to changes due to exchange rate fluctuations, local fees, taxes, or operational costs beyond our control.

6. Cancellations and Refund Policy
By the client:

More than 180 days before departure: 25% of the total amount.
-
Between 180 and 120 days: 50% of the total amount.
-
Between 120 and 60 days: 75% of the total amount.
-
Less than 60 days: 100% of the total amount.
Additional services (such as flights, insurance, or extensions) may be subject to different cancellation policies and may incur up to 100% penalty once confirmed or issued.
By Divers Tribe or providers:

If canceled due to force majeure (natural disasters, armed conflict, extreme weather, pandemics, government decisions, etc.), a reschedule will be offered or a partial refund will be issued, deducting any non-recoverable costs already incurred.

If cancellation is due to minimum group size not being met (when indicated), an alternative or full refund will be offered.
7. Booking Transfer
The client may transfer their booking to another person provided that:

Notice is given at least 60 days before departure.

The new participant meets all travel requirements.
-
Administrative fees and any additional costs resulting from the transfer are paid.

8. Liability and Insurance

Divers Tribe is not responsible for accidents, injuries, personal loss, delays, medical expenses, cancellations, or any other incidents occurring during the trip or participation in activities, except in cases of proven negligence directly attributable to our staff.

Participation in diving and adventure activities involves inherent risks which the client accepts upon registration.
-
Clients are required to purchase travel and diving insurance that covers: medical assistance, cancellations, emergency evacuation, hyperbaric coverage, baggage loss, and repatriation.

9. Programme Modifications

On "liveaboard" trips, itineraries may vary due to weather conditions, captain’s decisions, or operational reasons. Wildlife sightings and the completion of all scheduled dives are not guaranteed.

Any necessary modifications will be made prioritizing safety and trip quality.

In case of voluntary withdrawal from the trip, no refund will be issued, and any additional expenses will be the client’s responsibility.
10. Use of Images
Divers Tribe may take photos and videos during trips or activities for promotional, educational, or documentary purposes. By participating, the client authorises the use of their image unless they explicitly state otherwise in writing before the start of the program.
11. Data Protection
We are committed to protecting your personal data in accordance with Regulation (EU) 2016/679 (GDPR) and relevant Italian legislation. Personal information collected during registration and participation will be processed lawfully, fairly, and transparently, solely for purposes related to the provision of our services, client communication, and compliance with legal obligations.
You have the right to access, rectify, delete, restrict or object to the processing of your data, and to lodge a complaint with a supervisory authority. To exercise these rights, please contact us at info@diverstribe.com.

12. Force Majeure and Disclaimer
Divers Tribe is not responsible for damages, losses, or interruptions caused by circumstances beyond its reasonable control, including but not limited to: wars, strikes, acts of terrorism, pandemics, extreme weather conditions, border closures, civil unrest, government regulations, or third-party technical failures.
